When your cards touch the muck, they are dead. Forever. Period. Everybody knows that. Those are the rules. Let's move on.
This is one of the most familiar and universal of poker room rules.
Less well-known is an important exception. In Robert's Rules of Poker, Bob 'The Coach' Ciaffone describes it:
Figuring the Nuts in Texas Holdem. One of the first skills you must learn in Texas Holdem poker is the ability to read the cards on the board and figure out the best possible hand, known as “the nuts”. To players who have been at it a while, this is something done automatically and constantly, but to new players it is often overlooked or done incorrectly. In live poker you can check the nuts on the river if you are not the last one to act. If you are the last person to act and check back the nuts, its a penalty and it depends on the terms. Cards thrown into the muck may be ruled dead. However, a hand that is clearly identifiable may be retrieved and ruled live at management's discretion if doing so is in the best interest of the game. An extra effort should be made to rule a hand retrievable if it was folded as a result of incorrect information given to the player.

A Dispute Arises

Dealer:
'After I dealt the river card, I didn't see either player check or bet. When I said to Player A 'it's your turn,' she tabled her cards.' The dealer points to two cards laying face up in front of Player A, a jack and a nine. 'Then Player B pushed his cards forward without saying anything. It looked like he was folding and I placed them on top of the muck pile like I always do. But when I gave the pot to Player A, Player B objected, saying he had never acted, she had open-folded, and the pot should be his. Player B also said his exact cards were the king of diamonds and ten of spades, which in fact were the two cards on top of the muck pile.'
Player A:
'Well, I was first to act and checked. A couple seconds later, the dealer motioned towards me and said, 'it's your turn.' Knowing that I had already checked, I assumed the dealer was calling for the showdown, even though I never saw Player B check back. So I tabled my hand. With four diamonds out there, I'm never betting and can't call another bet, but my jack-nine gives me two pair, which might be good if Player B doesn't have a diamond in his hand.'
Player B:
'I never acted! I didn't see Player A check and the dealer never indicated the action was on me, so I was just waiting. She tossed her cards face up and towards the dealer before I acted, which is an open fold. She basically surrendered the pot by not waiting for me to act, so the pot belongs to me and I don't need to show my cards. That's why I slid my cards face down towards the dealer and let go of them. It doesn't matter that her cards are face up, because flipping them towards the dealer before I've acted is an open fold. And by the way, I had the nuts with the king of diamonds. Why would I ever fold the nuts?'
The dealer now indicates the two cards he says were retrieved from the top of the muck pile — and .

Management's Discretion
The supervisor's job is to gather and assess the facts, and then make a judgment call. Quickly! Is retrieving the dead cards from the muck, in this instance, in the best interests of the game? When Player A showed her hand prematurely, before Player B had either bet or checked back, did that lead to the unintended consequence of Player B appearing to fold because he thought the hand was over and the pot would be his?
In this case, the supervisor ruled that letting the cards speak is in the best interests of the game. No one doubted that Player B had the nuts after he named the exact rank and suit of his hand, which matched the top two cards on the muck pile. Player B's hand was retrieved from the muck and declared live, and he was awarded the pot.
The Ruling is Correct by Definition
Using discretion under intense time pressure, in public, is a lot easier said than done. When a floor supervisor has to decide whether retrieving dead cards from the muck 'in the best interest of the game,' he or she needs enough space to gather and evaluate the facts. Somebody is going to be unhappy.
Poker Rules Check Back The Nuts
The supervisor has to be both the judge and the jury. But the ruling is always correct, in the sense that is reflects the supervisor's best judgment, in the moment, of the game's best interests. If the supervisor in the example above had given the opposite ruling, it would still be correct because it would still reflect the supervisor's use of judgment and discretion.
In any case, it's good to know the rule about what happens to cards that hit the muck, and to be aware of this exception and how it is handled.

In poker, the nut hand is the strongest possible hand in a given situation. The second-nut hand or third-nut hand (and so on) may refer to the second and third best possible hands. The term applies mostly to community card poker games where the individual holding the strongest possible hand, with the given board of community cards, is capable of knowing that they have the nut hand.
Usage in context[edit]
In Texas hold 'em, if the board is 5♠ 6♠ A♣ 9♠ 5♥, a player holding 7♠ 8♠ has the nut hand because those hole cards complete a 9-high straight flush of spades, which cannot be beaten by any other possible combination of hole cards and community cards. On the same board, the hand 5♣ 5♦ would be the second-nut hand, four of a kind fives; the third-nut hand would be any pair of the remaining three aces, making a full house, aces full of fives.
It is important to note that the actual nut hand may not be the same as the absolute nut hand; for example, if the board is 7♥ 2♣ K♠ K♥ 3♦ a player with K♣ K♦ has the absolute nut hand. However, any player with K-7 knows that he has the nut hand as it is impossible for another player to have two kings. The phrase may also refer to a hand in progress with cards yet to be dealt, as the player can be said to have the nuts at that time. For example if a player holds 7♠ 8♠ on a board of 5♣ 6♠ 9♥ he can be said to have the nuts, however if the next card comes 7♥ then 8-10 becomes the nuts. This makes some nut hands very vulnerable in nine-card games, such as Omaha hold 'em.
In high-low split games one often speaks of 'nut-low' and 'nut-high' hands separately. In Omaha hold 'em, if the board is, 5♠ 6♠ A♣ 9♠ 5♥, any player with 2-3 makes the nut-low hand, 6-5-3-2-A, while a player with 2-4 makes the second-nut-low hand, 6-5-4-2-A (the nut-high hands remain the same as in Texas hold 'em, in this case 7♠ 8♠ to make a straight flush, although one can go as low as aces full by introducing quads and straight flush blockers). Similarly, one can sometimes hear the term 'nut-nut', which refers to a hand that makes both the best possible high and low. In Omaha, with the same board as above, a player holding 7♠ 8♠ plus 2-3 of any suit has the nut-nut and is guaranteed no worse than a split of the low pot plus a win of the high pot.
Origins[edit]
A common and certainly apocryphal folk etymology is that the term originated from the historical poker games in the colonial west of America, where if a player bet everything he possessed, he would place the nuts of his wagon wheels on the table to ensure that, should he lose, he would be unable to flee and would have to make good on the bet. Since it would be expected that a player would only make such a bet when he had the best possible hand, the folk lore says that this is how the best possible hand came to be known as the nuts. It is also rumored[by whom?] that these historical games were played only in the winter, and therefore, the nuts that were placed on the table were 'stone cold', hence coining the term 'stone-cold-nuts'.[1]
Another explanation[citation needed] is that 'the nuts' originated from the old English usage of 'nuts', meaning 'any source of pleasure'.[2]
Another seemingly fitting explanation is that the term was derived from the UK English slang 'the dog's bollocks' or 'the mutt's nuts', meaning 'the absolute best'. However, this phrase originated around 1949,[3] and the term 'the nuts' pre-dates it.[citation needed]
